Full Terms of Service
1. Acceptance of Terms
By accessing or using the Truckers Ins. Inc website, requesting a quote, submitting a binding application, or requesting a Certificate of Insurance (COI), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these terms, you should not use our website or request our services. Your use of the website constitutes your acknowledgment that you have read, understood, and accepted these terms on behalf of yourself and your business.
2. Brokerage Services & Role
Truckers Ins. Inc is an independent commercial truck insurance brokerage. We arrange insurance coverage between you (the insured) and third-party licensed insurance carriers. We do not underwrite, insure, or guarantee any policy. Our role is to solicit quotes, present coverage options, facilitate the binding process, assist with regulatory filings, and provide ongoing policy service. All insurance policies are issued by, and all claims are administered by, the respective insurance carrier — not by Truckers Ins. Inc.
3. Quotes & Binding Applications
Any quote provided through our website, by phone, or by email is a non-binding indication of premium and coverage terms based on the information you provide. Quotes are subject to underwriting review and may be adjusted, declined, or withdrawn by the carrier. Submitting a binding application does not constitute a binder of insurance. Coverage becomes effective only upon the insurance carrier's written acceptance, full premium payment, and issuance of a confirmed binder. Any quotation is valid for the period stated and is subject to change if the risk details provided are incomplete or inaccurate.
4. Regulatory Filings & Compliance
We assist with federal and state regulatory filings including MCS-90, BMC-91X, BMC-32, and Form E & H as part of our brokerage services. You are responsible for maintaining active operating authority, providing accurate equipment and driver information, and notifying us of any material change in your operation. Filings are submitted to the FMCSA and state insurance departments in accordance with their respective requirements and processing timelines, which are outside our control.
5. Accuracy of Your Information
You are responsible for the accuracy and completeness of all information you submit, including your name, company details, USDOT or MC number, equipment schedules, driver records, and loss history. Providing false, misleading, or incomplete information may result in a quote that does not reflect your true risk, a denied claim, or cancellation of coverage by the carrier. You agree to promptly notify us of any changes that could affect your coverage.
7. Certificates of Insurance (COI)
Certificates of Insurance are issued based on the active policy terms and your requested holder information. A COI is evidence of insurance only — it does not amend, extend, or modify the underlying policy. We strive to deliver COIs promptly, but turnaround times may vary based on carrier verification, business hours, and volume. Emergency certificate requests are handled through our 24/7 support desk where available.
8. Limitation of Liability
To the fullest extent permitted by law, Truckers Ins. Inc and its affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our website or brokerage services, including but not limited to loss of profits, business interruption, or failure to bind coverage. Our total liability for any claim arising from these terms shall not exceed the fees paid by you to us for the specific service at issue.
9. Indemnification
You agree to indemnify and hold harmless Truckers Ins. Inc, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of your use of our website, your violation of these Terms, or your provision of inaccurate or incomplete information in connection with any quote, binding application, or filing.
10. Website Use & Intellectual Property
All content on this website, including text, graphics, logos, and design, is the property of Truckers Ins. Inc or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission. You agree not to use our website for any unlawful purpose, to disrupt service, or to attempt unauthorized access to our systems or data.
11. Third-Party Links & Carrier Networks
Our website may reference or link to third-party carrier websites, regulatory databases, and partner portals. We are not responsible for the content, accuracy, or privacy practices of any third-party site. References to specific insurance carriers do not constitute an endorsement, and carrier availability may vary by state and product line.
12. No Guarantee of Coverage
Nothing on this website should be interpreted as a guarantee that coverage will be issued, that a specific carrier will accept your risk, or that any filing will be approved by a regulatory authority. All coverage is subject to underwriting guidelines, state availability, and the terms set forth in your individual policy and binder.
13. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with a revised effective date. Your continued use of our website or services after any change constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
14. Governing Law & Disputes
These Terms of Service are governed by the laws of the state in which our brokerage is licensed, without regard to conflict of law principles. Any dispute arising from these terms or our services shall be resolved through good-faith negotiation and, if necessary, in the appropriate jurisdiction. Insurance-related disputes may also be subject to your state insurance department's consumer protection process.
